How do I get rid of the middle fremata in this situation?

I already tried changing the “max number of frematas” in the properties pannel. If I select "One per staff, then it picks the middle fremata (and gets rid of the bottom), and I need it to pick the bottom. For some reason, engrave will not let me change the placement of the fremata to “below” because it will also make the top fremata be placed below.
Is there a way to clean this up?

Sorry to be That Guy, but why would you notate it that way? Just put those notes in the upper staff.

following @dan_kreider 's suggestion, if you reset the cross staff notes, the fermatas (one per staff), will become “independent” and you can place them above and below as desired (in engrave mode):

A friend asked me to transcribe “Salut d’amour” and then tweak it for a different instrument + piano. I wanted to be true to the earliest published copy.
